These Terms of Service ("Terms") govern your use of products and services provided by Performance Emissions Ltd ("Performance Emissions," "we," "our," or "us"). By purchasing our products, using our website, or engaging our services, you ("Customer," "you," or "your") agree to be bound by these Terms.

2. Products and Services

2.1 Product Range

We manufacture and supply:

 

Liquid Fuel Conditioners: DP1 and DP2 formulations

Fuel Conditioning Tablets: PowerBoost Pro Pill, PowerBoost Fuel Pro Small, Marine tablets

Water Emulsifier: Sodium-based tank treatment

Related accessories and technical support

 

2.2 Product Specifications

 

DP1: 1L treats 4,000L fuel, shelf life 10 years

DP2: Available in 500ml (2,000L treatment) and 5L (20,000L treatment)

Tablets: 1g treats 70L fuel (standard), 0.5g for motorcycles (20L)

Treatment Ratios: As specified in product documentation

Compatibility: All combustion engines (petrol, diesel, marine)

3. Ordering and Pricing

3.1 Minimum Orders

 

Tablets: Minimum order of 10 treatments at £3.50 per treatment

Liquid Products: As specified in quotations

Custom Orders: Subject to separate agreement

 

3.2 Pricing

 

Current pricing: £150 per liter for liquid products

Tablet pricing: £3.50-£5.95 per 10-pack (varies by product)

Prices subject to change with 30 days' notice

Volume discounts available for fleet customers

 

3.3 Payment Terms

 

Standard Terms: 30 days from invoice date

New Customers: Payment in advance may be required

Established Customers: Credit terms subject to credit approval

Late Payment: Interest charges may apply as per Late Payment of Commercial Debts Act

 

4. Delivery and Risk

4.1 Delivery

 

Standard delivery within UK: 3-5 business days

International shipping available

Delivery costs additional unless otherwise agreed

Risk passes to Customer upon delivery

 

4.2 Inspection

 

Customer must inspect goods within 48 hours of delivery

Defects or shortages must be reported within 7 days

Failure to report constitutes acceptance

 

5. Performance Guarantees

5.1 Product Performance

We guarantee our products will deliver:

 

Fuel Efficiency: Up to 47% improvement in older engines, 10-20% in modern engines

Emissions Reduction: Up to 100% reduction achievable within 5 weeks

Engine Protection: DPF cleaning and carbon deposit reduction

Compliance: Meeting regulatory emission standards

 

5.2 Money-Back Guarantee

 

Full refund if products fail to deliver measurable improvements

Testing period: 30 days minimum usage

Independent verification may be required

Return of unused product required

 

6. Warranties and Liability

6.1 Product Warranty

 

Defects: 12 months from delivery date

Performance: As specified in product documentation

Shelf Life: 10 years when stored correctly

Replacement or refund for warranted defects

 

6.2 Limitation of Liability

 

Our liability is limited to the purchase price of products

We exclude liability for consequential or indirect losses

Product Liability Insurance: £20 million coverage maintained

Nothing excludes liability for death, personal injury, or fraud

 

6.3 Force Majeure

We are not liable for delays or failures due to circumstances beyond our reasonable control.

Trade secrets protected under Trade Secrets Act

Customers may not reverse engineer or analyze products

 

7.2 Trademarks

 

"Performance Emissions," "DP1," "DP2," "PowerBoost Pro" are our trademarks

Unauthorised use is prohibited

 

8. Compliance and Regulatory

8.1 Customer Obligations

 

Use products only for intended purposes

Comply with all applicable laws and regulations

Provide accurate vehicle/engine specifications

Follow application instructions

 

8.2 Regulatory Compliance

 

Products comply with UK and EU regulations

International certifications: ASTM, CE, EPA (where applicable)

Customer responsible for local compliance verification

 

9. Confidentiality

9.1 Technical Information

 

Product composition and manufacturing processes are confidential

Test results and performance data may be used for marketing

Customer data protected per our Privacy Policy

 

9.2 Business Information

 

Commercial terms and pricing are confidential

Neither party may disclose confidential information without consent

 

10. Termination

10.1 Contract Duration

 

Individual orders: Complete upon delivery and payment

Ongoing supply agreements: As specified in separate contracts

Either party may terminate with appropriate notice

 

10.2 Effect of Termination

 

Outstanding obligations survive termination

Confidentiality obligations continue indefinitely

Unused products may be returned subject to restocking fee

11.1 Support Services

 

Technical guidance on product application

Performance optimization advice

Troubleshooting assistance

Response time: 24 hours for technical queries, 1 hour for general inquiries

 

11.2 Training

 

Application training available for fleet customers

On-site support for major implementations

12. Dispute Resolution

12.1 Governing Law

These Terms are governed by English law and subject to the jurisdiction of English courts.

12.2 Dispute Process

 

Direct negotiation: 30 days good faith discussions

Mediation: If negotiation fails

Arbitration or court proceedings: As appropriate

 

13. Data Protection

14. Modifications

14.1 Changes to Terms

Continued use constitutes acceptance

15. General Provisions

These Terms, together with any quotations and order confirmations, constitute the entire agreement.

If any provision is invalid, the remainder remains in effect.

We may assign these Terms; Customer may not without our consent.

15.4 Notices

All notices must be in writing to the addresses specified in orders or agreements.
